I am posting here to be able to come back and find this a year or two from now when someone posts a comment about why the City of Branson does not do something about the use of the all important "family values" name being used to promote the nude resort on Bull Shoals lake called "Branson Fun & Frolic" or the new "Branson Gents" gentelmens club in Reeds Spring. Something like this will open and we (including myself) will be up in arms about it and one of you out there will say "Why doesn't the City do something about this" and we will have to then say, oh they tried, but they unanomously voted not to position themselves so they can try to protect all of us. Instead of letting this issuue die a quiet death, we now have a formal vote recorded that admitts we have NO say so about the use of the name Branson. At least the quite death that it could have had would have left a modicum of doubt. But we opened our mouths and removed all the potential to argue and protect the name Branson.

As much as I always appreciate your guidance and guardianship, I personally don't need protection from a 'fun and frolic' group, or a group of 'gents.' They sound rather harmless, if you were to ask me.

I was trying to make a point but not offend too many. The other make beleive business names would have gotten me in real hot water....

Where the Ol' Grizzley completely misses the point is...NO MATTER what should happen down the road "Namewise" the city simply DOES NOT have the power or the law to CONTROL THE USE OF THE WORD BRANSON. That is what their legal council NOW says.
Secondly, the abusive, heavy handed and utterly comical way the former city council and staff tried to enforce, the unenforciable, ranks them right up there with many "Tyrants of Yore".
Simply put the City has a Trademark on a design, NOT , control over the name Branson. Even their own LAWYERS now admits to this.
NOW to the point of protection of Branson.
I would suggest that if the city wants to protect it's FAMILY VALUES, it might start with something they can control. A good example of what they COULD RIGHTLY CONTROL was open walking down the street liquor consumption on Branson Landing Public Square.
They utterly failed in an arena that was under their control.
SO MUCH for their FAMILY VALUES!
City Hall should clean up their own act, before dictating to COUNTY residents.

As I said they did not go about this the right way. They messed up.

I dont know if there actually IS a 'right' way to go about this. I read your post about all the 'postive posturing' but even a letter written like that has no legal foundation to back it up. Its junk mail.

The good news is that my plans to open a "Branson Hotel and Casino" north of St Louis can now get underway. *wrings hands menacingly*
