Branson Use Tax on August Ballot

City to place use tax on August ballot

Branson voters will decide the fate of a 2 percent use tax. Branson aldermen voted 4-0 on first reading Tuesday to put the item on the Aug. 7 ballot.

According to Jamie Rouch, director of finance for the city, the use tax isn’t an increase to the local sales tax, but will allow the city to get it’s share of taxes already being collected.

“The use tax isn’t increasing the sales tax for the city of Branson,” Rouch said. “It’s simply allowing us to collect out-of-state online sales. Most of them are already being collected, we just don’t have the ability in the city to collect them.”

According to the Missouri Municipal League – an independent, statewide, nonprofit association that looks to develop agency for communities in the state – a use tax is a sales tax imposed on the purchase of goods by Missouri residents from out-of-state vendors.

Essentially, a staff report from the city states, a use tax would look to eliminate the advantage out-of-state retailers have over those located in Missouri.

Talk about a "money grab"...when you think about it, Sales Tax on an Internet purchase is the all-time rip-off. Government does nothing to "earn" that tax nor do they provide any service to justify it. Another theft from consumers.

absolutely ... The online tax is one of the biggest scams out there nationwide

One easy mantra to always follow: Just say NO to all new taxes...FORCE "your" supposed "public servants" to use the money already taken from you in responsible and productive ways....the squandering everywhere in government is appalling...the rest of us, and all business's that are capital market driven, and not taxpayer subsidized (such as Tesla, etc) must live on a BUDGET..it's way past time for these government entities, at all levels, be forced to do the same.

I truly don’t understand Branson’s explanation. Branson wants to “capture” taxes collected by the state. But how can the state legally collect taxes for Branson in the first place when they have yet to be voted in by the Branson residents? Branson’s media release says these taxes are “already being collected by the State.” I am very familiar with sales and use tax laws and Branson’s explanation makes absolutely no sense.

Timely, KY3 did this story on their early news.

The way it was explained, Branson is not attempting to start a new tax. The tax is already being collected, and it is going to the State. Branson has to vote to get what should be theirs to begin with, the local "use tax" on online sales made by Branson residents.

If a use tax issue passes, when people in Branson buy online, that sales tax money, which is already being collected, would go to the city.

Branson’s media release says these taxes are “already being collected by the State.” Huh?

Currently, Branson's use tax rate is 4.225% because it’s just the state rate; there is no additional city (or Taney county) rate that’s tacked on because the city & county voters haven’t approved a local use tax. FYI - This issue was presented to Branson voters many years ago but the residents voted it down. On the flip side, Stone County does have a local use tax rate of 5.975% because Stone County voters voted in 1.75% use tax rate in addition to the existing state rate of 4.225%. Kimberling City has a whopping local use tax rate of 7.975% that includes Kimb City use tax, Stone County use tax and state use tax. In fact, many locales in Missouri have voted in local use tax but not Branson (or Taney County).

So I don’t understand how the state is supposedly collecting use tax for Branson from online vendors when Branson doesn’t have a use tax. What rate are these supposed online vendors charging for items shipped to Branson when there is no rate? What Branson is putting out there does not make sense.

I agree it is confusing . . . the State getting tax already being collected, intended for Branson, because Branson has not voted to receive it.

Huh!?

Seems like Branson, and other localities, could sue the State, retroactive.
