No.. it is still looks terrible .... not sure about the runoff.

Hoping to answer a few questions, I pulled in there today.

First, if it ever does become a real development, something will have to be done with HWY 76 at the entrance to IR. It is at absolutely the worst place it could be, both for entering and comping back out. StoneBridge being very close makes it worse. I'm guessing some sort of controlled interchanges. next time you're heading west on 76, take note of how tough a turn into IR would be.

Second, it is a spectacular piece of property!

Third, underground utilities . . . water, sewer and electric . . . appear to already be in place throughout. So, a lot has already been spent.

Fourth, I was not bold enough to go close enough to Table Rock to view runoff, but it does not appear that anything has been done to the slopes to keep water from eroding down into the draws, and into the lake. The roads are not eroded seriously.

Fifth, I saw no signs of the missing line of credit.

Someone else can go check on that.

The holler with those buildings was just ordered sold at the end of july by judge stephens in galena. you can read his judgment and order to sell the property by going to the state of missouri judicial website. find case net and do a search by case number 09sn-cc00092. when the case comes up click on the docket entry tab to get to the online judgment.

Special Order of Fieri Facias to Seize and Sell Real Property (Exhibit B to Judgment dtd April 27, 2012).

Judgment Entered

In addition to ruling on all claims, cross claims and counterclaims as set forth below, judgment is rendered granting mechanics liens or materialmen liens on all or parts of Parcel 34, Indian Ridge Resort Community totaling $531,203.97, plus pre-judgment interest and costs. All of the liens granted herein are adjudged to have priority over all other liens, encumbrances or interests in or on any of the lots in Parcel 34. Judgment is also rendered as set forth below on cross-claims for indemnity and in favor of subcontractor claimants for breach of contract and where applicable, for violation of the Prompt Pay Act. By a separate special order of fieri facias issued to the Sheriff of Stone County, the real property comprising Parcel 34 is ordered seized and sold on July 30, 2012 at 1:00 p.m. The Court retains jurisdiction for the purpose of marshalling, applying and distributing the proceeds of the sale of said property, to determine the total amount of pre and post-judgment interest and costs to be added to the claims granted herein prior to distribution of proceeds and to issue such writs of assistance or other proper process as may be necessary to enforce the separate order of sale rendered herein. There being no just reason for delay, this judgment is certified as final for the purposes of appeal of the adjudication of the validity of the various mechanics lien claims, the principal amount of said claims and the priority of said claims over other interests. So, at the same time one court of law will be trying the principals for criminal misconduct another court has ordered the sale of their ill-gotten fruits to satisfy mechanics liens.

The investors got screwed and those who did the work got screwed.

FIERI FACIAS
The name of a writ of execution. It is so called because, when writs were in Latin, the words directed to the sheriff were, quod fieri facias de bonis et catallis, etc.; that you cause to be made of the goods and chattels, etc.

The foundation of this writ is a judgment for debt or damages, and the party who has recovered such a judgment is generally entitled to it, unless he is delayed by the stay of execution which the law allows in certain cases after the rendition of the judgment, or by proceedings in error.

Note the "unless he is delayed by a stay of execution."
